The rules for using this website and the conditions that apply when you book a tour with us.

In these terms "we", "us" and "the Organiser" mean the company above; "you" and "the Traveller" mean any person using the website or booking a tour.

2. Scope of these terms

  1. These terms govern the use of this website and form part of every contract for a tour concluded with us.
  2. By using the website or confirming a booking you accept these terms. If you do not agree with them, please do not use the website or book a tour.
  3. Individual arrangements confirmed by us in writing take precedence over these terms.

3. Use of the website

  1. The website provides information about our tours and about travel in India. It is free to use and requires no registration.
  2. You agree to use the website lawfully and not to interfere with its operation, attempt unauthorised access or copy its content by automated means.
  3. We take care to keep information accurate and current, but descriptions, photographs and travel tips are for general guidance and do not constitute a binding offer or professional medical or legal advice. Entry rules and local conditions can change at short notice.
  4. The website may contain links to external sites. We are not responsible for their content.

4. Offers, prices and booking

  1. Itineraries and prices shown on the website are an invitation to enquire. A contract is concluded when we send you a written booking confirmation after you have accepted our individual offer and paid the deposit.
  2. Prices are quoted in US dollars per person, based on double occupancy, unless stated otherwise. The services included and excluded are listed on each tour page and in your offer.
  3. Prices do not include international flights, visa fees, travel insurance, tips or personal expenses unless expressly stated.
  4. After confirmation, the price may change only because of increases in taxes, government fees, fuel surcharges or exchange rates beyond our control, and no later than 20 days before departure. If the increase exceeds 8% of the tour price, you may cancel free of charge.
  5. The trip-cost calculator on the website gives a non-binding estimate.

5. Payment

  1. A deposit of 20% of the tour price is due on booking.
  2. The balance is due 30 days before arrival. For bookings made within 30 days of arrival, the full price is due on booking.
  3. Payment can be made by bank transfer or by card through a secure payment link. Bank and card charges are borne by the payer.
  4. If the balance is not paid on time, we may, after a reminder, treat the booking as cancelled by you.

6. Changes and cancellation by you

Changes to dates, hotels or the route are free of charge up to 30 days before arrival, subject to availability and any price difference. You may cancel at any time in writing; the following charges apply:

Non-refundable items purchased on your behalf (internal flights, train tickets, safari permits, festival-period hotel deposits) are charged in full regardless of the date of cancellation. You may transfer your booking to another person who meets the conditions of the tour, by notifying us at least 7 days before arrival and paying any resulting costs.

7. Changes and cancellation by us

  1. We may make minor changes to the itinerary (for example the order of visits or an equivalent hotel) when necessary for operational or safety reasons.
  2. If we must make a significant change before departure, we will inform you without delay; you may accept the change, choose an alternative tour or cancel with a full refund.
  3. We may cancel a tour because of unavoidable and extraordinary circumstances (such as natural disasters, epidemics, political unrest or official travel warnings). In that case you receive a full refund of the amounts paid, without additional compensation.

8. Travel documents, health and insurance

  1. You are responsible for holding a valid passport, the appropriate Indian visa and any vaccinations required. General guidance is available in our Travel Tips.
  2. Travel insurance covering medical expenses and repatriation is compulsory. For high-altitude tours it must cover emergency evacuation above 3,000 metres. We recommend cancellation cover.
  3. You must inform us before booking of any medical condition or reduced mobility that may affect your participation.

9. Your responsibilities during the tour

  1. You agree to follow the reasonable instructions of our guides and drivers, local laws and the rules of hotels, monuments and national parks.
  2. You are liable for damage you cause to third parties or service providers.
  3. We may exclude from the tour, without refund, a traveller whose behaviour endangers others or seriously disrupts the trip.

10. Liability

  1. We are responsible for the proper performance of the travel services included in your contract.
  2. We are not liable for loss or damage caused by you, by third parties unconnected with the services, or by unavoidable and extraordinary circumstances.
  3. To the extent permitted by law, our liability for damage other than personal injury or damage caused intentionally or by negligence is limited to three times the tour price.
  4. Wildlife sightings, weather conditions and the opening of mountain passes cannot be guaranteed.
  5. Nothing in these terms limits rights that consumers have under mandatory provisions of law.

11. Complaints

  1. Please report any problem during the tour immediately to your guide or to our 24-hour number so that we can resolve it on the spot.
  2. Written complaints can be sent to contact@visit-to-india.com within 30 days of the end of the tour. We reply within 30 days.
  3. Consumers resident in the European Union may also use out-of-court dispute resolution bodies in their country of residence.

12. Intellectual property

All texts, itineraries, graphics and the logo on this website are protected by copyright and belong to us or to our licensors. You may view and print pages for personal, non-commercial use. Any other reproduction or distribution requires our prior written consent.

13. Governing law and final provisions

  1. These terms are governed by Polish law. This choice does not deprive consumers of the protection of mandatory provisions of the law of their country of habitual residence.
  2. Disputes will be settled by the competent courts; for consumers, according to the general rules of jurisdiction.
  3. If any provision of these terms is found invalid, the remaining provisions stay in force.
  4. The processing of personal data is described in our Privacy Policy.
  5. We may amend these terms; bookings are governed by the version in force on the date of the booking confirmation.
